Audio guide transcript project update

Update: Our meeting went very well and it looks like we will be able to post nearly all the transcripts openly in CONTENTdm. We will know for sure next week after a couple of minor questions are run by Antenna’s general counsel.

There may be one or two transcripts where non-Museum persons (e.g. Sarah Jessica Parker) were included on a recording and spoke in their own words, i.e. not off of a prepared script.  We will address those items individually.

The issues are/were:

  • the use of literary quotations (all are too brief to be problematic);
  • music (a non-issue because we’re not posting the audio files); and
  • whether or not republishing the transcripts online for educational purposes/for free constitutes a fair and low-risk use of the content (all indications are that it is fair and acceptable).

For the last couple of months we’ve been working towards getting the transcripts of the Museum’s audio guides into CONTENTdm so that they can be searched and printed at will. This would allow us to provide a better product and better service than we can get out of the binders of printed transcripts held in the Nolen Library.

Antenna Audio (the company that produces the guides) has been reluctant to give us permission to post the transcripts online, despite the fact that the Museum is a co-holder of the copyright and our Counsel’s office believes it is an appropriate “Museum use” of the content allowed under our agreement with Antenna.

Tomorrow (Thursday 11/17), Robyn, Oleg and I will be meeting with staff and legal counsel from Antenna, Cristina Del Valle from our Counsel’s office, and Stella Paul from Digital Media.

We’ll know more about where this project stands then and I’ll post an update afterwards.

    Update, Nov. 30, 2011: Museum Counsel is waiting for an indemnification document from Antenna’s Counsel. Once Cristina has looked it over and made sure she’s ok with the language we’ll be cleared to post the transcripts.

    For future reference: we solely own all rights to audio guides produced beginning July 2010, so the Museum is free to repurpose the content in any way we see fit. This agreement expires in July 2012, so rights negotiations for later audio guides will begin very soon and likely continue through the spring.
